Terms of Service
Last updated: May 4, 2026. Plain English. The TL;DR: $500 to start, first month included, then $197/month for hosting, maintenance, reporting, and reasonable monthly improvements.
1. Who we are
Stackd is operated by Luke Whaley, a sole proprietor based in St. George, Utah, USA. Reach us at hello@stackd.build or (435) 272-5293.
2. What you're buying
For $500 to start, first month included, then $197 per month, you get:
- A custom website or landing page.
- Service copy, contact paths, mobile layout, and basic local SEO.
- A contact form, click-to-call links, and simple reporting.
- A domain: we register a new one for you or accept a transfer of one you already own. We manage it under our registrar account during your subscription; if you cancel, we transfer it into a registrar account in your name at no cost.
- Hosting, SSL certificate, and uptime monitoring.
- Daily backups and security updates.
- Edits when you ask: text us a change request, we usually ship within 48 hours.
We don't guarantee a specific Google ranking, traffic number, or business outcome. We do guarantee a working, fast, accessible website that we maintain for you.
3. Billing
- $500 to start. Your first month is included, then $197/month is billed in advance and recurring monthly.
- Charged automatically on the same day of each month via Stripe.
- No annual contract.
- Receipts emailed to you by Stripe.
- If a payment fails, we'll email you and try again. After three failed retries we may suspend the site (we'll always email first).
4. Cancellation
- Cancel any month, from your Stripe receipt or by emailing us.
- Cancellation takes effect at the end of the current billing period: you keep service through the month you already paid for.
- If you want to take the live site as a static export (HTML, CSS, images) and self-host it, that's a one-time $1,997 buyout, available any month with no waiting period. We otherwise retain the site files.
- If you don't need the export, you can just cancel: the site comes down at the end of the current billing period, no fees, no fuss.
- Domain on cancellation. If you brought your own domain, it stays with you, always; we simply unpoint its DNS. If we registered one for you, we manage it during your subscription and transfer it into your own registrar account at no cost on cancellation, regardless of whether you take the static-export buyout. Either way, the domain follows you out the door.
- No prorated refunds for partial months.
5. Your content, your rights
- Anything you give us (copy, photos, branding, business info) stays yours. We don't claim ownership.
- By giving us your content, you grant us a non-exclusive license to use it for the purpose of building and maintaining your site.
- You promise the content is yours to share, or you have permission to share it. If a third party claims you don't, that's on you, not us.
6. Our work, our rights
- The custom site we build for you is yours to keep on cancellation (as a static export).
- Reusable templates, internal libraries, and tooling we develop for our overall service stay ours.
- You don't resell the Stackd service or rebrand our work as your own agency's.
7. What we can't promise
We provide the service “as is.” We do our best to keep your site up, fast, and secure, but we don't guarantee it'll never go down. We don't guarantee any specific business outcome (traffic, leads, ranking, sales).
Our maximum financial liability to you, in any single dispute, is capped at the amount you paid us in the preceding three months. We aren't liable for indirect, incidental, or consequential damages: lost profits, lost data, etc.
8. What you agree not to do
- No illegal content. No content that infringes someone else's rights.
- No spam pages, link farms, scams, or anything that could get the site (or our shared hosting) blacklisted.
- If you do any of the above, we may suspend or terminate the service without refund.
9. Changes to these terms
If we change these terms meaningfully, we'll email active subscribers at least 30 days before the new terms take effect. If you don't agree, cancel anytime: no penalty. Continuing to use the service after the new terms take effect means you accept them.
10. Governing law & disputes
These terms are governed by the laws of the State of Utah, USA. Disputes go to the courts in Washington County, Utah. Before filing anything, both sides agree to email and try to resolve it in good faith. Most things can be sorted with a conversation.
