Terms of Service
Last updated: June 21, 2026. Plain English. The TL;DR: $500 one time to build and launch your site, then $30 a month for hosting and upkeep, and $40 an hour for changes after launch. No setup fee, no contract.
1. Who we are
Stackd is operated by Luke Whaley, a sole proprietor based in St. George, Utah, USA. Reach us at hello@stackd.build or (435) 272-5293.
2. What you're buying
For a one-time $500 you get a custom website, designed, built, and launched. After that, $30 a month covers hosting and upkeep, and any changes you ask for are billed at $40 an hour. Specifically:
- A custom website, built for your business.
- Service copy, contact paths, mobile layout, and basic local SEO.
- A contact form and click-to-call links that go straight to your phone and email.
- A domain: we register a new one for you or accept a transfer of one you already own. While we host your site we manage it under our registrar account; if you stop hosting with us, we transfer it into a registrar account in your name at no cost.
- Hosting, SSL certificate, and uptime monitoring, included in the $30 a month.
- Daily backups and security updates.
- Changes when you ask: text us a request, billed at $40 an hour, and we usually ship within 48 hours.
We don't guarantee a specific Google ranking, traffic number, or business outcome. We do guarantee a working, fast, accessible website that we maintain for you.
3. Billing
- The build is a one-time $500, due once you approve the site and want it live.
- Hosting and upkeep are $30 a month, billed in advance and recurring monthly.
- Changes after launch are $40 an hour, quoted up front for anything beyond a quick edit.
- Charged via Stripe. Receipts emailed to you.
- No annual contract.
- If a hosting payment fails, we'll email you and try again. After three failed retries we may take the site offline (we'll always email first).
4. Cancellation
- Stop the $30 a month hosting any month, by emailing us.
- It takes effect at the end of the current billing period: you keep hosting through the month you already paid for.
- You own the site. When you stop hosting with us, we hand you the files (HTML, CSS, images) so you can host it elsewhere, at no extra cost.
- Domain on cancellation. If you brought your own domain, it stays with you, always; we simply unpoint its DNS. If we registered one for you, we transfer it into your own registrar account at no cost. Either way, the domain follows you out the door.
- No prorated refunds for partial months.
- The one-time $500 build fee is non-refundable once the site is live, since you approve it before we launch.
5. Your content, your rights
- Anything you give us (copy, photos, branding, business info) stays yours. We don't claim ownership.
- By giving us your content, you grant us a non-exclusive license to use it for the purpose of building and maintaining your site.
- You promise the content is yours to share, or you have permission to share it. If a third party claims you don't, that's on you, not us.
6. Our work, our rights
- The custom site we build for you is yours. You can take it and host it elsewhere any time.
- Reusable templates, internal libraries, and tooling we develop for our overall service stay ours.
- You don't resell the Stackd service or rebrand our work as your own agency's.
7. What we can't promise
We provide the service “as is.” We do our best to keep your site up, fast, and secure, but we don't guarantee it'll never go down. We don't guarantee any specific business outcome (traffic, leads, ranking, sales).
Our maximum financial liability to you, in any single dispute, is capped at the amount you paid us in the preceding three months. We aren't liable for indirect, incidental, or consequential damages: lost profits, lost data, etc.
8. What you agree not to do
- No illegal content. No content that infringes someone else's rights.
- No spam pages, link farms, scams, or anything that could get the site (or our shared hosting) blacklisted.
- If you do any of the above, we may suspend or terminate the service without refund.
9. Changes to these terms
If we change these terms meaningfully, we'll email active clients at least 30 days before the new terms take effect. If you don't agree, stop the hosting anytime: no penalty. Continuing to use the service after the new terms take effect means you accept them.
10. Governing law & disputes
These terms are governed by the laws of the State of Utah, USA. Disputes go to the courts in Washington County, Utah. Before filing anything, both sides agree to email and try to resolve it in good faith. Most things can be sorted with a conversation.
